Terms of service

These terms apply to MarketGround at marketground.io and app.marketground.io, operated by MarketGround, referred to as "we." Creating an account or using the service means you agree to these terms. If you act for an organization, you confirm that you have authority to bind it. In that case, "you" includes the organization.
1. The service
MarketGround lets you define geographic areas and reports estimates of the population, demographics, businesses and travel access within them, built from the data sources described on our methodology page. We may change or improve the service over time. If we discontinue a feature your plan depends on, we will tell you in advance where we reasonably can.
2. Your account
You must provide a working email address, keep your password confidential and be at least 16 years old and able to enter a contract. Each account and plan seat is for one named individual and must not be shared. You are responsible for activity under your account. Email contact@marketground.io if you believe someone has used it without your permission.
3. Plans, limits and payment
The pricing page lists each plan's limits, including projects, saved areas, seats, travel duration and assistant use. The service applies those limits and identifies when one has been reached. We may change Free plan limits at any time.
Paying. Paid plans are billed by card through Stripe, monthly or yearly as you choose at checkout, and renew automatically at the end of each period until you cancel. The price shown at checkout is before tax. Sales tax or VAT is added where the law requires it, based on the billing address you give.
Seats. Pro is one seat. Team is billed for the number of seats you choose, five at minimum. If more people join the organization than you hold seats for, a seat is added for each of them automatically, and removing members never bills you below the seats you hold. You can change the number of seats at any time. Changes within a billing period are prorated.
Changing plan. You can change between Pro and Team, or between monthly and annual billing, in settings. Changes take effect immediately. Charges or credits are prorated for the unused portion of the current billing period.
Canceling. You can cancel from your settings at any time. The plan stays active until the end of the period you have paid for and then moves to the free plan. Your projects and saved areas are kept, and anything above the free plan's limits stays readable but cannot be added to. We do not refund partial periods, except where the law gives you that right.
Failed payments. If a renewal payment fails we will retry it for a few weeks and Stripe will email you. If it still fails, the subscription ends and the organization moves to the free plan.
Price changes. We may change prices with at least 30 days' notice by email. A change applies from your next renewal after the notice period. If you do not accept it, cancel before then.
4. What you may do with the results
You may use the analyses, maps and exports the service produces for your own business purposes, including in reports, presentations and decisions, internal or for your clients. Attribution to MarketGround is appreciated but not required for ordinary use.
You must not extract underlying data in bulk through automated means or attempt to reconstruct our datasets or models. You must not resell, sublicense or redistribute the service or its outputs as a dataset or competing product.
You must not probe, disrupt or bypass security, usage limits or access controls, or access another organization's data. You must not use the service to identify, track or make decisions about individual people, or use it in breach of applicable law.
5. Your content
The projects and areas you create are yours. You grant us only the permission needed to store them, analyze them and show them back to you and the people in your organization. We do not use your content to train models or share it with other customers.
6. Data sources and their licenses
MarketGround uses third-party data under the licenses that apply to each source. You agree to respect those licenses when using the relevant portions of the output.
US Census Bureau data is public domain. LandScan USA from Oak Ridge National Laboratory is provided under Creative Commons Attribution 4.0. Overture Maps places use CDLA-Permissive 2.0. Preserve the attribution supplied with that data when redistributing it. OpenStreetMap data uses the Open Database License. Transit timetables come from their publishing agencies under each agency's own terms, and the Muni and SamTrans timetables come from the Bay Area 511 open data program under its terms.
7. What the numbers are
Every figure the service reports is an estimate. Population is allocated from census counts onto a grid. Demographics are survey-based and carry the survey's own margins of error. Daytime population for recent years is modeled from commuting data. Business listings reflect the sources' latest release and may be out of date for any individual place. Where a figure is approximate, the interface says so. We work hard to make the estimates accurate and we publish how we check them, but we do not warrant that any figure is correct, and decisions you take on the basis of the service are yours.
8. Availability
We aim to keep the service available at all times but do not guarantee it. We may suspend it for maintenance, or suspend an account that breaches these terms or endangers the service, giving notice where we reasonably can.
9. Liability
To the extent the law allows, the service is provided as is, and we are not liable for indirect or consequential losses, lost profits, or decisions made in reliance on the service. Our total liability to you for any claim arising from the service is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars if you paid nothing. Nothing here limits liability that cannot be limited by law.
10. Ending the relationship
You can close your account at any time by asking us at contact@marketground.io, and we delete your account and its content as described in the privacy policy. We may close an account that breaches these terms. Sections 4, 6, 7 and 9 survive closure.
11. Changes to these terms
We may update these terms. For a material change, we will publish the revised terms and notify account holders by email at least 14 days before the change takes effect. Using the service after that date means you accept the revised terms.
12. Governing law
These terms are governed by the laws of the State of Colorado, United States, and disputes will be resolved in its courts, unless the law where you live gives you a right to something else.
