Terms of service

These terms govern your use of MarketGround, at marketground.io and app.marketground.io, operated by MarketGround ("we"). By creating an account or using the service you agree to them. If you are using the service on behalf of an organisation, you confirm you have authority to bind it, and "you" includes that organisation.

1. The service

MarketGround lets you define geographic areas and reports estimates of the population, demographics, businesses and travel access within them, built from public data as described on our data and methodology page. We may change or improve the service over time. If we discontinue a feature your plan depends on, we will tell you in advance where we reasonably can.

3. Plans, limits and payment

Each plan has limits, listed on the pricing page, on things like projects, saved areas, seats, travel-time duration and assistant use. The service enforces them, and when you reach one it tells you which. Paid plans are not yet on sale. When they are, the price, billing period and cancellation terms will be shown before you pay and will form part of these terms. We may change the limits of the free plan at any time.

4. What you may do with the results

You may use the analyses, maps and exports the service produces for your own business purposes, including in reports, presentations and decisions, internal or for your clients. Attribution to MarketGround is appreciated but not required for ordinary use.

The projects and areas you create are yours. You grant us only the permission needed to store them, analyse them and show them back to you and the people in your organisation. We do not use your content to train models or share it with other customers.

The service is built on data from third parties, each under its own licence, which you also agree to respect when you use their portions of the output:

7. What the numbers are

Every figure the service reports is an estimate. Population is allocated from census counts onto a grid. Demographics are survey-based and carry the survey's own margins of error. Daytime population for recent years is modelled from commuting data. Business listings reflect the sources' latest release and may be out of date for any individual place. Where a figure is approximate, the interface says so. We work hard to make the estimates accurate and we publish how we check them, but we do not warrant that any figure is correct, and decisions you take on the basis of the service are yours.

8. Availability

We aim to keep the service available at all times but do not guarantee it. We may suspend it for maintenance, or suspend an account that breaches these terms or endangers the service, giving notice where we reasonably can.

9. Liability

To the extent the law allows, the service is provided as is, and we are not liable for indirect or consequential losses, lost profits, or decisions made in reliance on the service. Our total liability to you for any claim arising from the service is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars if you paid nothing. Nothing here limits liability that cannot be limited by law.

10. Ending the relationship

You can close your account at any time by asking us at contact@marketground.io, and we delete your account and its content as described in the privacy policy. We may close an account that breaches these terms. Sections 4, 6, 7 and 9 survive closure.

11. Changes to these terms

We may update these terms. If a change is material we will post the new version here with a new date and notify account holders by email at least 14 days before it takes effect. Continued use after that date is acceptance.

12. Governing law

These terms are governed by the laws of the State of Colorado, United States, and disputes will be resolved in its courts, unless the law where you live gives you a right to something else.
